Texting Behind The Wheel Results In $22 Million Dollar Verdict
It was Thanksgiving weekend 2007 as Megan Small, a 21 year-old pharmacy major at Baylor University traveled back to Waco after enjoying the holiday with her family. Unfortunately, heading the other direction that day was Texas A&M student Jason Vestal. Vestal crossed into Megan’s lane and struck her head-on, killing her instantly. Vestal initially claimed he did not remember the accident and did not have a cell phone with him in the car. The Smalls’ attorney later subpoenaed Vestal’s phone records and discovered that the A&M student had sent or received 15 text messages and made 7 phone calls in the final few minutes before the crash. In fact, the data indicated that Vestal was receiving a text and quite possibly trying to return that text at the exact moment that he crossed into Megan’s lane.
The evidence is clear that those who utilize their cell phones while driving run a much greater risk of being in an accident than those who do not. Taking one’s eyes off of the road, even for a second, can have devastating consequences.
